Corporate Foreign Investor Visa (D-8-1)

A. Eligibilitybility

Indispensable professional specialists who want to engage in the fields of business management, administration, production, or technology in a foreign-invested company registered in Korea according to the Foreign Investment Promotion Act (hereinafter to be referred to as the D-8-1 visa).

B. Visa application

Basic requirements

  • The investment target should be a Korean corporation (only a corporation that has completed incorporation).
  • The investment amount should be KRW 100 million or more while the foreigner owns at least 10/100 of the total number of voting stocks issued by the Korean corporation (Article 2 (2) 1 of the Enforcement Decree of the Foreign Investment Promotion Act or the foreigner owns stocks, etc. of a Korean corporation and dispatches or appoints an executive officer (Article 2 (2) 2 of the same Act).

Where to apply

In principle, the application should be made at the Korean mission in the applicant's home country.

* When the applicant resides abroad and operates a business (including long-term residents with a permanent residence permit, etc) there, he/she can make a visa application at the country's Korean diplomatic mission.

C. Application for a visa issuance certificate

Basic requirements

  • The investment target should be a Korean corporation.
  • The investment amount should be KRW 100 million or more while the foreigner owns at least 10/100 of the total number of voting stocks issued by the Korean corporation (Article 2 (2) 1 of the Enforcement Decree of the Foreign Investment Promotion Act or the foreigner owns stocks, etc. of a Korean corporation and dispatches or appoints an executive officer (Article 2 (2) 2 of the same Act).

Where to apply

The application should be made at a relevant immigration control office (including an office or a branch office).

D. Application for change of status of sojourn

Foreign investors who have not been issued a D-8 visa before entering Korea may enter the country without a visa (only in countries with a visa waiver agreement or countries from which no-visa is allowed temporarily) or entry with a C-3-4 (short-term commercial) visa before applying for a change of status of sojourn at a relevant immigration office or KOTRA's Investment Center Consulting prior to doing business.

E. Documents required for visa application or change of status of sojourn

  • Integrated application (Form no. 34)
  • Passport and a passport photo
  • For people from a high TB-burden country, a TB checklist (a confirmation certificate issued by a health center or a medical institution designated by the Ministry of Justice, which you can check at http://www.immigration.go.kr)
  • A dispatch order and a certificate of employment (A dispatch order issued by a foreign-invested company (affiliate) written in the certificate of foreign-invested company registration or by the head office (parent company) of a foreign-invested company is accepted. The dispatch period should be specified. Necessary documents, including an annual report, should be submitted to prove the relevant employment.)
  • Documents such as engineering certificates, career certificates, diplomas, organizational charts, etc Needed to certify that person is an indispensable professional specialist (i.e. executives, senior managers specialists, specialists), (except for executives listed in the register)
  • A copy of the business registration certificate, a certificate of all matters registered in the corporation registration book within three months (Those subject to per-business unit taxation should make a separate submission)
  • A copy of the foreign-invested company registration certificate
  • Proof of arrival of investment funds
  • Proof of sales performance (if there is one)
  • A sojourn place certificate: A real-estate-rental contract, a residence/accommodation offer certificate, the providers' ID copy, etc
    ※ Residence accommodation/offer certificates (the sojourn location certificates in the event that applicant is not the tenant written on the rental contract): A real estate lease contract, etc.
  • A copy of the business location rental contract
    * A copy of the sublease contract in the case of a sublease contract (with the building owner's consent or approval indicated on the contract copy)
  • Fee: Fees for extension of the period of stay, changes thereof, etc are exempted for Corporate Investment (D-8-1)
